State Governor's Powers over their own National Guard

I will be running for Governor of Nevada - 2026

A state governor generally has the authority to activate and command the National Guard within their state for state-level emergencies. This is known as State Active Duty (SAD). In this capacity, the governor acts as the Commander in Chief of the state's militia, responsible for ensuring public safety and responding to emergencies. Examples of when a governor might activate the Guard for SAD include: 

This constitutionally illegal crap that trump is pulling with the threat to federalize the California National Guard is the crap that makes me seriously consider running for governor - again,in 2026 - as I did in 2014.  If it's a constitutional crisis Trump wants, it's a constitutional crisis he'll get if I'm elected governor of Nevada. 

As this situation unfolds - all of America will witness if Governor Gavin Newsom has the stones to be president of the republic - or will he run and hide like a solitary mouse. He's either a man or a mouse.

The California Nation Guard are his alone - as governor - to command (the governors of every American state are the commanders-in-chiefs of their state's National Guard) not trump's as he'd have Americans think. He needs Governor Newsom's permission - and we know what his [Newsom's] answer should be. 

I've laid out the facts of the matter for you in plain English - below.

And, you'd think [that] the governor of the largest state in our republic - with a GDP of $4.103 trillion, the world's fourth-largest economy, behind only the U.S., China, and Germany - would have the stones to tell trump to go fuck himself?  That's what I'll tell him as governor of Nevada were the citizenry of Nevada to come out in protests of any kind against federal government criminality - like what we're witnessing currently regarding these mass arrests and deportations. 


Natural disasters: Hurricanes, floods, wildfires, and other catastrophic events requiring assistance with relief efforts, maintaining order, and providing support.

  • Civil disturbances: Riots, widespread protests, or other situations requiring the Guard's assistance in maintaining order and enforcing laws.

  • Law enforcement: In some cases, the governor can activate the Guard to assist with law enforcement, and they may have the power to investigate, arrest, and incarcerate when authorized.

  • Important Considerations:
  • Federalization: The President of the United States can federalize the National Guard, placing them under federal command and control, particularly during times of war or national emergencies. When federalized, Guard troops become part of the active-duty federal military.


  • Posse Comitatus Act: When the National Guard is federalized, they are generally bound by the Posse Comitatus Act, which restricts the use of federal military personnel for civilian law enforcement purposes. This means that when the Guard is federalized, they cannot typically engage in law enforcement activities like making arrests or conducting searches and seizures, unless there's a specific legal exception, such as the Insurrection Act.

  • Title 32 Status: There's a middle ground where the National Guard operates in "Title 32 status." In this status, the Guard is federally funded but remains under the command and control of the state governor. This allows the Guard to perform federally-defined missions, often training exercises or specific support missions, while remaining under state authority.

  • Governor Consent: Before federal agencies take actions impacting the National Guard, states and territories must be consulted and the governor's consent must be obtained. Governors have expressed a desire to maintain full authority over their National Guard units to ensure readiness and ability to respond to emergencies and disasters.

  • In summary, a state governor holds considerable power over their state's National Guard, primarily for state-level emergencies and operations. However, this power can be superseded by federal activation, and the Guard's status and legal authority may change depending on whether they are operating under state, Title 32, or federal (Title 10) command.

Upon their election every US [state] governor will decide who to appoint as the state's adjutant general of their national guard. 

They can either keep the previous one or personally vet a new one for the state. The current Nevada national guard is this man - Berry Ondra - that the previous governor (another wet noodle of a Nevada governor) Steve Sisolak made the AG.

Lombardo has decided to keep Ondra for reasons that are very obvious when you look into his background as a former cop. What's that saying about fish rot from the head? 

This entire immigration illegality that we see from Trump is but the test question, the cautionary tale of what he can get away with with our nation's governors.  As governor of Nevada I'll vet an AG of Nevada's national guard who takes his marching orders from one person, and one person alone, the Nevada governor - period. 

He will not take directions under any circumstances from the DoD nor the president. In my vetting process I will make it crystal clear to this person to whom they are to answer, any answer I get of an ambiguous nature,that doesn't affirm my position on the chain of command will see that interviewer shown the door.  Were they to do so, they'd be fired on the instant and replaced (as I'll have a pre-signed letter of resignation with a backup candidate already in the wings that will follow the law on the matter of who is commander-in-chief of their states national guard).

Leave men like Trump,Hegseth and Musk to me,those people crawled out of the sewer and I know how to deal with sewer rats and men who hear their corrupt fathers voices in their heads - in Trump's case,from the grave.

 As with them, I house the same deep, abiding admiration for my dad, I,too, am, "my father's son" (as the saying goes.."a chip off the old block").

This dyed in the wool, Democratic-Socialist regards Trump as a joke, he could no more bully me than could the world's strongest termite.

 Let the citizenry of Nevada put GOV in front of Allen Rheinhart, and Trump's playtime in Nevada is over - along with his brown nosing Apartheid Israel ardent zionist sycophant lil Joey Lombardo being shown the door. Resenting, Lil Joey, affirmed Trump's illegal attacks on the Islamic Republic of Iran - I seriously doubt if he even knows if he could locate Iran on a world map - he speaks like one that is learning disabled.  Be reminded that it was Trump who took our nation out of the JCPOA that Obama arranged. 

 

 
 
As with the corrupt political philosophy of Zionism Trump (a man who'd fail Robert Hare's CLR - Test tries to make us think through his warped, Dunning-Kruger Effect warped psychology).
 
In much the same manner that those of us with implacable moral compass resists Zionism murderous beliefs, so, too we will resist Trump's moral degenerate beliefs.

 

And last,but certainly not least - the governor of Nevada, unlike all the other governors in our American Republic, isn't invested with the legislature powers of the other 49 governors. That person doesn't have full pardon powers along with countless other legislation handcuffs - all done purposely mind you at the birth of the state  - during the Civil War, in 1864, when Nevada joined the Union,along with West Virginia, the only two states to do so during the Civil War period.

It was purposely set up without all the needed legislative tools to operate as a state like all the other states in the union. In fact, we just obtained an appellate court system after 150 years in existence (in 2014).  A person could be railroaded or clearly wrongly convicted of a crime, yet a Nevada governor on their own couldn't do what governors across the nation can do - namely, issue a pardon and set the person free from a corrupt judiciary or jury hell-bent on convicting somebody, anybody,to feed a certain faction of the populace's blood lust. 

It's not a real governorship as you know a governorship.  A full 67% of the land that is Nevada is wholly controlled by the federal government - The Bureau of Land Management - BLM. That's 48 million square miles not under our control and ours alone.  I can go down the list of legislative failures that go out the door and round the block.  

This foolishness, along with other national concerns is why I support a 28th amendment to the Constitution of the nation for the State of Nevada to exit the republic and become its own sovereign nation - The [Democratic] Republic of Nevada.   We are a house divided, hence we need to go our separate ways - now - bring this failed experiment in for a soft landing,before it comes in for a crash landing - full blown civil war,because that's where this is headed - and Trump's endless unlawfulness is exponentially speeding up the process.  We're not going to come to agreements that suit all sides, so let's just agree to disagree and end this charade before bloodshed is all that's left.
